These Terms of Service ("Terms") govern your use of the services provided by llullaowpn B.V. ("we", "our", or "us"), a company registered in the Netherlands with registration number 27496851 and VAT number NL697453218B125, located at Schoolstraat 164, 4894 RE Breda, North Brabant, Netherlands.
By booking any tour, using our website, or engaging with our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services. These terms constitute a legally binding agreement between you and llullaowpn.
llullaowpn provides outdoor tour and adventure services in the Netherlands, including but not limited to cycling tours, nature walks, water adventures, and custom outdoor experiences. All tours are conducted by qualified guides and include the provision of necessary equipment and safety gear as specified in individual tour descriptions.
Bookings can be made through our website, by telephone, or by email. A booking is confirmed once payment has been received and you have received written confirmation from us. Full payment is required at the time of booking unless otherwise agreed. Prices are quoted in Euros and include VAT where applicable. We reserve the right to change prices at any time, but changes will not affect confirmed bookings.
Cancellations made more than 48 hours before the tour start time are eligible for a full refund. Cancellations made within 48 hours of the tour start time are subject to a 50% cancellation fee. No refund will be provided for no-shows or cancellations made less than 24 hours before the tour start time. We reserve the right to cancel tours due to weather conditions, insufficient bookings, or other circumstances beyond our control, in which case a full refund or rescheduling will be offered.
Participants must be in reasonable physical condition appropriate for the chosen tour. You must disclose any medical conditions, injuries, or limitations that may affect your ability to participate safely. Participants are required to follow all safety instructions provided by guides and use provided safety equipment. You are responsible for bringing appropriate clothing and personal items as specified in pre-tour communications. Participants must be at least 16 years old unless accompanied by a parent or guardian.
Outdoor activities involve inherent risks, and participants engage in tours at their own risk. While we take all reasonable precautions to ensure safety, we cannot eliminate all risks associated with outdoor activities. Participants acknowledge that they understand these risks and agree to follow all safety instructions. We strongly recommend that participants have appropriate travel and activity insurance.
All content on our website, including text, graphics, logos, images, and software, is the property of llullaowpn or its content suppliers and is protected by Dutch and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without explicit written permission. Our company name, logo, and tour descriptions are trademarks of llullaowpn and may not be used without permission.
During tours, we may take photographs or videos for promotional purposes. By participating in our tours, you consent to the use of your likeness in our marketing materials unless you specifically opt out. You retain the right to request removal of your image from our promotional materials at any time.
To the maximum extent permitted by Dutch law, llullaowpn's liability for any claim arising from or relating to our services is limited to the amount paid for the specific tour in question. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, regardless of the theory of liability. This limitation applies even if we have been advised of the possibility of such damages.
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, weather conditions, natural disasters, government actions, strikes, or other events of force majeure. In such cases, we will work with you to reschedule or provide alternative arrangements where possible.
Your personal data will be processed in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR). By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
Participants must conduct themselves in a respectful manner towards guides, other participants, and the environment. Prohibited behaviour includes but is not limited to harassment, discrimination, destruction of property, littering, or any conduct that endangers safety or disrupts the tour experience. We reserve the right to remove participants who engage in prohibited conduct without refund.
All participants are expected to follow Leave No Trace principles and respect the natural environment. This includes staying on designated paths, not disturbing wildlife, properly disposing of waste, and following all environmental guidelines provided by guides.
We reserve the right to terminate or suspend access to our services immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason in our sole discretion. Upon termination, your right to use our services will cease immediately.
We reserve the right to modify these Terms of Service at any time. Changes will be effective when posted on our website with an updated revision date. Your continued use of our services after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.
These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands. If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
If any provision of these Terms of Service is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be struck and the remaining provisions shall remain enforceable to the fullest extent permitted by law.
These Terms of Service, together with our Privacy Policy and any additional terms provided for specific services, constitute the entire agreement between you and llullaowpn regarding the use of our services and supersede all prior agreements and understandings.
